AstraZeneca has agreed to pay $75m to settle allegations relating to the sale and possession of an inhaler containing Ventolin HFA and albuterol as its top-selling inhaler. The case has been brought to the U. S. District Court in New Jersey by GlaxoSmithKline
The agreement was announced on Thursday afternoon by a British pharmaceutical and medical device firm, AstraZeneca, which has been a major shareholder in AstraZeneca's asthma and related products.
The agreement is subject to customary conditions in relation to the sale and possession of the inhaler.
The company will be entitled to an interest in the settlement and the other damages it may incur in relation to the suit, including loss of profits, lost revenues and other damages related to the suit, AstraZeneca has said.
The AstraZeneca deal has been in place for several years and is still considered one of the largest deals for the world’s pharmaceutical industry.
Last year, AstraZeneca bought out the majority stake in GlaxoSmithKline Plc, a major U. K.-based company that sells asthma medications like Ventolin HFA and its generic, albuterol sulfate inhalers HFA.
In November, GlaxoSmithKline, together with other companies, launched an investigation into the sale and possession of the inhaler. The probe has been launched in the United Kingdom and New Zealand.
GlaxoSmithKline said it had received more than 1 million emails, faxes and text messages from AstraZeneca and the company's other key employees over the past year. It has also received more than 3,300 emails from other companies in the same period.
The deal with AstraZeneca was expected to last until the end of the year, when the company will have the full rights to the deal.
AstraZeneca is also seeking damages from GSK's diabetes unit, GSK is buying out the British drugmaker, and other UK-based companies.

“We have no plans to launch or sell any product that would be associated with this agreement in any way or form,” AstraZeneca said in a statement. “It is not known that the settlement would result in any other damages arising from this settlement.”
